Ontario couple go to court over health concerns related to wind farms

Canadian Press:   TORONTO – A southwestern Ontario couple whose family farm sits in a proposed wind farm say they are being blocked in their efforts to determine if the turbines cause any adverse health effects.  Shawn and Tricia Drennan’s farm north of Goderich sits in the proposed Kingsbridge II wind farm and one turbine will be about 650 metres from their house.

Shawn Drennan says they heard some people living near an earlier wind farm project sold their properties to the wind farm operator after suffering health problems.

But the Drennans say they couldn’t talk to those people because they were banned from discussing health issues by a non-disclosure clause in their sale agreements.

The Drennans have taken their case to the Superior Court of Justice in an effort to have the gag orders lifted so that they can determine if their health will be adversely affected by the turbines.

Their lawyer Julian Falconer says some jurisdictions, such as Florida, ban the use of non-disclosure agreements when health or safety is concerned.

Ontario’s panel that rules on turbine approvals has ruled that there are “legitimate concerns and uncertainties about the effects of wind turbines on human health,” but noted there is a lack of peer-reviewed science on both sides of the debate.

“This is an extraordinarily bizarre set of events which this government (Ontario) has set in motion,” Falconer said Tuesday.

“Rather than creating very clear, credible research before subjecting the Drennans to this type of nightmare, they would opt instead … to subject them to it to see how it turns out,” he said.

Shawn Drennan said his family has lived on the farm for nearly 90 years and they don’t want to leave their community.

“We’re concerned for our family, our livestock, our farm, but also for our community,” Drennan said. “My grandfather bought the farm we’re living on … in 1922.”

Drennan said all they want to be able to do is talk to the people they believe have been affected by wind turbines.

“We need to talk to them to get medical evidence that we can utilize to protect ourselves,” he said.

Falconer said the case could be heard as early as November.

  2. I hope the Drennans family case will crack the shell industry has put around itself. There has been problems in Nova Scotia (Yarmouth area); there has been in France (http://www.ventdecolere.org/ ). People have been looked at as anti green development and what not. Yet no utility or government agency came with insurance there would be no noticeable impact on farm animals, people, grounding the local electric grid,.. I would try to get a picture too of how the farm is operating to make the wind turbine owners liable for any adverse impacts on the farm.

    You have to ask a question – with McGuinty Liberals governing – evidence of a collapsing economy;
    the rural countryside turned into an industrial hell hole; citizens begging for ‘just relief’ from privateers tearing into their lives; legitimate safety issues; and so on……………..

    Question:
    How many lawyers did it take – to get – McGuinty Liberals – into that comfort zone?
    ……..like counting jelly beans in a jar!

    • “Third World Democracy”, that`s what it feels/looks like to me Free Thinker! About as bizarre as it can be, right here in what used to be ‘good ole Ontario’.
      I`m having great difficulty, trying to imagine what`s going on in the brains/thoughts of those who are planning to re-elect Lying Liberals, again! How bad does it have to get, before they wise up, and how on earth can people think it`s ok for pols. to continually lie?
      How do they pick out any true tidbits, if there are any? I just don`t get it! Don`t they care?
      It`s this voter attitude, which has destroyed politics in Ontario. You can`t blame the politicians, it`s 90% the voters fault, for the cynicism blamed for low voter turnout.
      We can once again, be Canadas` economic engine within several years of good governance, or we can carry on the present path downward, and be Canadas` basket case for 25,plus years to come. That`s our choice. Vote Cons & go up or vote Libs/NDP & continue going down. Scary when you think of it!

  4. I live near a few and I do not have a gag order,even so this gag order is BS as so is our fraudulent government. They should spill their beans and let the people know they do wake you up at night and cause headaches and other health effects , these guys are going to live so close they will eventually have some sort of effects that will affect their lives and have every right to dig for the truth even though it is right there all over the world, What a BS world. The suspension of democracy, disenfranchisement of citizens, and carpeting of prime farmland (now valued between $5,000 and $10,000 an acre) just so we can position ourselves to sell power to the United States when they might decide to stop using coal someday (McGuinty–LFP Sept. 13/11) is a total disgrace. The Drennans and all the rest of us deserve better than this. When are we going to be heard? Hudak might or might not be the answer; it’s just too tenative to depend on that outcome alone. Life has too many vagaries for us to be caught up in a battle with a crew that doesn’t care if you lose everything you have worked for over a lifetime. Yes, for the most part it’s wait and see on until your worst fears become a reality and you find yourself a refugee in your own land. Our rights as citizens are being trampled. There has to be some redress in the courts. Selling out and signing a gag order only allows these hoodlums to perpetuate their crimes against our society. They are actually having us sign agreements that mitigate our rights. I always thought that you aren’t allowed to sign away your rights. Something is wrong with this picture.

  6. In my mind the landowners who have signed for IWT contracts are just as liable for any health effects from turbines that are on their land, they are the ones who do this willingly upon their neighbors and former friends, They can not hide behind the turbine company’s forever.

    If I do something on my land that makes my neighbors sick then I am liable, lets say there is poison spilled, then I can’t hide behind Monsanto either.
    But if I let it happen that Turbines are build on my land, and my neighbors get sick, then I would go out free of charge because I could hide behind turbine company, I don’t think so, not forever.

    A landowner can’t get liability insurance for the IWT structures that are build on his or her land, The insurance industry has it figured out already.

  7. Yes, landowners should assume liability since they have a pecuniary interest; but to be fair, they were sold a bill of goods by a powerful machine. The voting public is still being sold the ideology with our own tax dollars. The options they signed nearly a decade ago gave them a lousy deal, and the industrial turbine wasn’t even on the horizon then. Everything except rights of citizens has barged ahead. Shame on us for lying down and taking this.
